T.O.S - Terms of Service Version 0.1.2
YOU MUST OWN THE CHARACTER RIGHTS OF THE CHARACTER YOU ARE LOOKING TO COMMISSION
__________________________________________________________________________________________________
By placing a commission with us, you agree that you either legally own the rights to the character/design or have full permission from the rightful owner to have it made. We are not responsible for copyright infringement on your behalf. Any legal claims made against us due to misrepresented ownership will be redirected to you.
Order Process:
In the beginning, we will negotiate and discuss your commission information with you in detail to compose a specialized and detailed invoice that covers all the major components, details, functionalities, and specific aspects of the commission. These details will be recorded in order to make your project to these specifications.
An invoice will be provided after negotiations. If you do not receive this information soon after negotiations, you may have to request it, and it will be provided promptly. Please save this information on multiple devices and/or print it for records.
Changes to the invoice details or requests for additional add-ons not covered in the invoice can incur more charges and lead to timeline delays. We will never begin work on something before you agree to the terms/commission details and pay.
Commissioners must be paid in full or on a negotiated payment plan before we begin work on the commission. Measurements and/or a DTD (duct tape dummy), if receiving a bodysuit, must be provided. Failure to provide a DTD or required measurements within 60 days may result in your slot being postponed or canceled.
We provide Work in Progress (WIP) photos during the construction process. Some WIPs represent construction milestones. We require these milestone WIPs to be approved by you before proceeding with the process.
These milestones include, but are not limited to: images of fur/fabric swatches, the sculpting of the head, the head carved before it is furred, and images of the completed fursuit. If you do not respond to WIP approvals within 14 business days, we reserve the right to proceed to avoid extended production delays.
Edits during the Construction Process:
We work from your reference images and detailed invoice to create your commission. If we send a WIP and you want small adjustments along the way, we will try to accommodate this within reason.
If you want changes that go against previously discussed details or previously confirmed WIPs, then we might need to charge extra for those changes to happen. This is because we have completed the commission to your previously stated specification, and an adjustment against those statements creates more work. We will let you decide if you want to pay for the accommodation or if we should proceed as-is. Significant design changes may reset your estimated completion date.
Code of Conduct:
We expect all clients to communicate with us in a respectful, professional manner. Harassment, threats, hate speech, or manipulative behavior will not be tolerated and may result in your commission being canceled without refund (depending on the situation).
We reserve the right to block, ban, or otherwise cease communication with any person who violates this code.
Toxic behavior, including spamming, excessive message frequency, or harassment about queue times, may result in delayed service or removal from our client list.
Payments:
Customers can either pay in full or start a payment plan.
Payment Plans require you to be able to put down 32% of the total cost of your commission up front, unless otherwise agreed upon. After that, you can make monthly installments of 8.5% until it's paid off, unless otherwise agreed upon.
We do not add you to the queue until either you pay in full OR a payment plan has been established. Our queue is based on the website, Trello, and should be accessible for commissioners to check in at any point.
If postponed payments are needed for a while, we may be able to work with you. Please email us directly to give us a heads up before payments are due to discuss your options. Options can include, but are not limited to, pausing production until you can start paying again, a partial refund, or reducing the list of components you want to purchase so your total is lower.
100% of the commission total cost is required to be paid in full before we will ship the items to you.
We prefer payment through PayPal. However, if you can not use this program, we may be able to work with you to achieve payment utilizing a different platform. Please discuss this with us during the negotiation process.
All prices are listed in USD unless stated otherwise. Any applicable currency conversion or transfer fees are the responsibility of the buyer.
If we do not hear from you/receive a payment for more than two months, you will run the risk of your commission’s price increasing due to an increase in supply, labor, and time costs.
If we do not receive any form of communication about payment being delayed from you, and you are in default on payments towards your payment plan for over four months, we will consider your commission as abandoned, and that you have forfeited all payments made as well as your commission itself. No refunds will be given in this case.
Deadlines, Rush Orders & Convention Delivery:
We do not guarantee completion of your suit by a specific date unless explicitly agreed upon in writing at the time of payment.
If you need a suit completed before a certain event or convention:
You must inform us during the initial negotiation process.
Rush fees of 30%–50% of the commission total may apply, depending on how soon the item is needed and how full our queue is, unless otherwise stated.
We reserve the right to decline rush orders during high-traffic seasons or if we cannot reasonably meet your timeline.
We are not responsible for delays due to shipping issues, customs holds, or emergency situations (e.g., illness, natural disasters, or material shortages).
Color/Fabric Matching:
Please be aware that there is a limited color palette available for fabrics (fur, fleece, minky cuddle, faux leather) compared to the limitless possibilities that can be depicted in reference art. We try our best to match colors as best we can, but there may be some times when there is no close match to a color in your reference. We will provide you with the closest color samples we have access to for you to choose from. It may take a few weeks to receive the color samples, depending on the material and shipping conditions.
We cannot guarantee fabric matches to previously purchased items or items made by other makers, but we will try. We try to match as closely as possible, but sometimes fabrics are discontinued, and/or sometimes colors obtained from the same manufacturer can vary between dye batches. Color selection confirmation is required before we proceed with fabric cutting.
Wearability of Fursuits:
The buyer understands that fursuits are bulky, claustrophobic, hot, and have less visibility than normal eyesight. We are not responsible for any injury you may incur while in or around our suits/products. Including, but not limited to: fatigue, overheating, heat stroke, heart attacks, falls, and slips.
Please make sure to take care of yourself while in the suit. As well as remember to eat before suiting, hydrate through drinking water (before, during, and after), take regular breaks, and/or have a friend be your handler in both familiar and unfamiliar territory when suiting. These will help reduce and prevent the risk of bodily harm.
By purchasing a suit, you acknowledge that you accept full responsibility for your safety while wearing it.
Buyer Responsibility:
Buyer must provide an accurate reference sheet, duct tape dummy, shoe size, measurements, and/or other previously specified information, if applicable. We rely on these to make your commission accurate.
We do not begin final additions until the customer has paid in full or makes a payment plan, AND we have received their measurements.
Our turnaround time varies depending on the specifics of the commissions and the previously agreed-upon timeline, from the date of the full payment or payment plan, AND receipt of the commissioner's measurements (and DTD, if relevant). This can vary if a design is particularly complex, a specific material is out of stock, or if there are highly unique components, features, padding, etc.
Things that could delay your completion time:
Not sending your measurements and/or DTD within 2 months of payment.
Not responding to email communications (especially when we send WIPs, we need approval) in a timely fashion.
Changes to designs or add-ons mid-way through the commission.
Delay in commission payments (unless noted previously)
Shipping:
We insure packages for the full value of your commission and require signature confirmation for your safety. Additionally, we will do our best to ensure that your commission is packaged and padded to the best of our ability to increase its safety during transit.
Upon shipment, you will be sent an automated confirmation email that includes your tracking number. Please check your email for your notification.
The average shipping time is 3-5 business days within the United States and 7-12 days internationally. These times may vary.
Please be aware that international orders (those outside of the United States) may be subject to customs charges and holds that are entirely out of our control. These are country-specific taxes that many places charge when goods are imported. We did not charge you for these taxes, and are therefore not responsible for paying them. If a package is returned due to non-payment of customs fees, reshipping will require additional payment.
Fursuit Warranty:
If your suit arrives with any fitting issues or is defective in any way, please contact us (wear-wolves@outlook.com) right away to arrange an edit. If we are in error, we are responsible for shipping both ways.
Your fursuit has a 3-month warranty from the date of arrival to you, the buyer. This covers repairs of rips, popped seams, sizing adjustments, and adhesion failure. Please contact us to arrange a fix. While under warranty, the buyer pays shipping to the seller, and the seller pays shipping back to the buyer. The buyer is responsible for ensuring the suit is returned to us in a clean condition.
Warranty does not cover damage incurred from misuse or rough-housing in a fursuit. Repairs due to pet damage, improper cleaning, or storage are also not covered. It does not cover sizing issues due to the buyer providing incorrect measurements. Making adjustments to the fursuit yourself can void the warranty. If modifications are made by another party, we are not responsible for any resulting issues or damage.
Suit Repairs:
Please expect your suit to go through normal wear and tear. The bottom of the feet wears down, airbrushing fades over washes, etc. If you take proper care of your fursuit, it can last for years. However, there are times when your suit may need touch-ups or small fixes.
We can do these fixes, replace items, or touch up airbrushing if needed. Please see our entry above concerning color/fabric matching.
You may contact us at any time you need a repair. We will assess the damage and charge accordingly based on the estimated hours to fix the problem. Buyer to pay shipping both ways.
The buyer is responsible for ensuring the suit is returned to us in a clean condition. Suits returned for repair in an unclean state will be returned at the buyer’s expense or subject to a $120 cleaning fee.
Fursuit Refunds:
Please be sure you want the commission and it is within your budget before purchase!
Refunds are only available for fursuits that are currently in production. Production is defined as the point in time when a customer has begun paying for their suit, up until it is fully completed.
Please email us directly if you have any reason to seek a refund. We would like the opportunity to work with you to ensure you are getting what you want, and we would like to assist you if any problems arise.
If you decide to get a refund, we automatically keep at least 20% of the full commission amount as a fee for supplies and time spent in communications. That rate increases as we get further into your construction process. We will determine how much is due for a refund based on the amount of work we have completed.
Once a Fursuit has been constructed, it is no longer eligible for a refund. Chargebacks without prior contact will be considered fraudulent and result in a ban from future commissions.
Seller’s Rights:
We reserve the right to cancel an order for any reason. The buyer will be issued a full refund in that case. We reserve the right to adjust our Terms of Service agreement at any time, notifying you if that occurs. We reserve the right to refuse service to individuals who are abusive, disrespectful, or who have a history of TOS violations or chargebacks.
Photos of Commissions:
We reserve the right to use any photography or videos that we take of the commissioned work for any reason, such as posts to our social media, advertising of any kind, or print materials. Buyers may request that we do not post photos until after a certain date (e.g., for convention debuts or gifts), but must inform us in advance.
